Refunds & Cancellations

This document outlines the general refund and cancellation policies of SophMedia LLC, it's agents and subsidiaries.

Unless a customer's individual contract stipulates to the contrary, customers may cancel their service or deliverables at any time within the inclusion of their applicable contracted terms.

Reoccurring Product Refunds

A refund for a reoccurring product must be requested within thirty (30) days of the most recent reoccurring payment due date. Refunds for reoccurring services are only rendered in partial or full form to the most recent payment. Refunds for service periods extending beyond the most recent payment are handled on a case by case basis and are granted at the discretion of SophMedia LLC.

For reoccurring services (billed continuously at a specific interval), refunds are only provided on first-time accounts. For example, if a customer has had an account with SophMedia LLC for a particular service and restored service at a later date, they are not again eligible for subsequent refunds.

Tangible/Digital Product Refunds Refunds for non-reoccurring products must be requested within thirty (30) calendar days of original purchase, or first payment, whichever occurs first. Refunds for rendered services, included web development, web design, application development, application design, and consulting are offered on a case by case basis with proper justification (determined at the discretion of SophMedia LLC). Refunds for digital or tangible products are rendered on any case provided that the maximum amount or entirety of a tangible product is returned. An example of this is for prepaid voice-over-ip services, where there is pre-paid airtime remaining and returned to SophMedia LLC, it's agents, or subsidiaries. For advertising related services, as long as there is a positive balance or remainder of the purchased goods, refunds are provided without justification.

Refunds for metered services, including but not limited to, internet advertising, prepaid voice over IP, are pro-rated based on the remaining duration or positive balance.

Cancellation Requests

Cancellation Requests for any product or service must be served via e-mail or online via a cancellation form to SophMedia LLC. Phone cancellation requests must be confirmed in writing by the customer prior to actual cancellation for verification purposes.

Cancellations are only granted to customers with a positive or zero balance on their account. Customers with a negative balance against SophMedia LLC are required to render payment for the balance owed to SophMedia LLC or the proper SophMedia LLC agent or subsidiary.

Refund Requests

Refunds are offered on a strict customer request only basis. To qualify for a refund a customer must submit a refund requests within fifteen (15) days of the customer's effective date of cancellation.

Any violation of SophMedia LLC, SophMedia LLC's agents or subsidiaries Terms of Service, or contract termination prior to the expiration of a contract, unless agreed to prior, will automatically void this refund policy contained herein.
Terms of Service

This page outlines the general terms of service of SophMedia LLC, it's agents and subsidiaries herein referred to as SophMedia LLC. SophMedia LLC reserves the right to change or add to these policies at any time without prior notification. Customers are responsible for keeping current at least on a thirty (30) calendar day period.

Payments

Payment for reoccurring services are due at least one calendar day prior to the origination of service. Payments not received within thirty (30) calendar days of the date due are considered late and may incur late fees and/or service suspension. Additionally, customers reactivated suspended services may incur reactivation charges. Customers with a balance fourty-five (45) days past their due date, or fifteen (15) days of past due notification, whichever occurs first, may be subject to service termination.

Indemnification Policy

Customers must agree to use all SophMedia LLC services, products, and facilities at your own risk. SophMedia LLC specifically disclaims all warranties of any purpose unless agreed upon by a statutory agent of SophMedia LLC. Customers must also agrees that they shall not hold SophMedia LLC, it's agents or subsidiaries liable for any financial or data loss nor commercial, including but not limited to special, incidental, or consequential damages.

Disputes

All disputes between a customer, it's agents, or related representatives when interacting within a reigning court of law, must take place in Maricopa County, Arizona. If a customer does not file disputes within Maricopa County, Arizona, their disputes are automatically unjustified.
